Application Form for CBPOA Architectural Control Committee (ACC):
No building, fence or wall shall be erected, placed or altered on any lot until the construction plans and specifications and a plan showing the location of the structure, fence or wall has been approved in writing by the Architectural Control Committee as to the quality of workmanship, materials, harmony of external design with existing structures, and as to location with respect to topography and finished grade elevation.
No building shall be erected, altered, placed or permitted to remain on any lot other than one (1) detached single-family dwelling not to exceed one (1) story in height and a private garage for not more than three (3) cars.
No structure of a temporary character, trailer, basement, tent, shack, garage, barn or other out building shall be used on any lot at any time as a residence either temporarily or permanently.
All permits, variances including but not limited to USFWS, Baldwin County and any other applicable governing agencies must be approved by the ACC, prior to construction, including the setting of pilings.
Applicant is responsible for notifying the ACC of any public hearings, if any type of variance is requested from Baldwin County, AL.
Plans, specifications and site plan should be submitted along with application on new home construction. Any deviation after submission, must be resubmitted and approved by the ACC prior to construction, including the setting of pilings.
A copy of the as-built survey that is submitted to USFWS upon completion of construction should be submitted to the ACC.
Baldwin County, AL Zoning Ordinance (Cabana Beach Estates is located in District 25) is attached for download; definitions from the ordinance are below. Cabana Beach Covenants' maximum height requirement of one (1) story supersedes the maximum height of two (2) habitable stories for District 25 in Baldwin Co, AL Zoning Ordinance.
"Story: That portion of a building included between the surface of any floor and the surface of the next floor above it, or if there is no floor above it, then the space between such floor and the ceiling next above it."
"Story, habitable: A story having its floor elevated at or above base flood elevation as determined from the flodd insurance rate maps, regardless of the intended use of the story or its floor area."
"Attic: An unfinished area below the roof and above the ceiling of the living or garage area of a single family dwelling which is generally used for storage and/or the location of mechanical equipment but not for human habitation."
"Basement: A story all or partly underground but having at least one-half of its height below the average level of the adjoining ground."
CONSTRUCTION IMPACT FEE:
A $1500 fee is due upon approval by the ACC/Board of the application for construction of a new home only. The fee is not applicable to a home rebuilt because of a hurricane, high winds, fire or other natural causes. The fee amount is based on the cost of one load of gravel for the private roads in our subdivision.
